Welcome to Deztination (“we,” “us,” “our”). At Deztination, we protect your privacy with applicable data protection laws. This Privacy and Cookie Policy (“cookies”) informs you about our practices regarding the collection, use, and sharing of your personal information and the use of cookies and similar technologies on our website.

Personal Information ” is information about a natural person which, alone or in combination with other information, could be used to identify that person.

We need to collect, use, and disclose personal information to carry out our business activities and functions, including making and managing customer travel reservations. We are firmly committed to protecting the privacy and confidentiality of personal information and maintain various physical, electronic, and procedural safeguards to protect the personal information entrusted to us.

For the purposes of the General Data Protection Regulation (the “GDPR”) and related legislation, we are a “data controller” (or equivalent) in respect of the processing of personal information you provide to us in connection with:

  • Our provision of leisure and business travel services.
  • Event management services.
  • The provision of leisure transportation services, and
  • Our overall marketing activities.

There may be instances where your local data protection legislation imposes more restrictive information handling practices than those set out in this Statement. Where this occurs, we will adjust our information handling practices in your jurisdiction to comply with such local data protection legislation.

  1. Information we collect

“Personal Information” as defined under your local data protection legislation and, where the GDPR applies, the meaning of “personal data” as defined in the GDPR. Personal information generally means information about a living individual who can be identified from that information or from that information and other information in the possession of another person, including any expression of opinion, whether true or not, and whether or not recorded in material form, concerning an identified or reasonably identifiable individual, as well as any indication of intention concerning an individual.

In general, the type of personal information we collect about you is necessary to facilitate your travel bookings and arrangements and to arrange travel-related services and/or products on your behalf.

We may collect the following types of information, without limitation, when you use our website:

  • Contact information: name, date of birth (or age), e-mail address, and telephone number you voluntarily provide when you register, subscribe to our newsletter, fill out a form, or use our services.
  • Your payment account information (credit/debit card details, including card type, card number, security number and expiry date) ;
  • Your passport details, known traveler number, and rectification number or.
  • Loyalty program details.
  • Health information such as dietary requirements and medical conditions (if applicable).
  • Other details relevant to your travel arrangements or required by the relevant travel service provider (s) (e.g., airlines and accommodation or tour operators).
  • Connection information: IP address, web browser, Internet service provided, operating system, and other technical information when you visit our website.
  • Information concerning products and services purchased, consumed, or offered, as well as data concerning website traffic and visits insofar as this data is associated with an individual’s personal information.
  • Usage information: the pages you visit, the time you spend on our website, the links you click, and other data concerning your interactions with our website.

Personal Information does not include personal information that has been anonymized by removing identifying details so that the data cannot be associated with a specific individual.

We may also collect your personal information when you contact us for other purposes. For example, we may collect your personal information to contact you about a contest you have entered (e.g. if you win) or to respond to an inquiry or comment you have sent us. We also collect information necessary for use in the business operations of Deztination and our related entities, including, for example, financial details needed to process various transactions, audio, electronic and visual information (e.g., video surveillance images) used for security purposes, voice recordings for quality control and dispute resolution, as well as relevant personal information you may have chosen to provide to us.

In certain circumstances, we may collect personal information from you that may be considered sensitive information under your local data protection legislation. Sensitive information may include but is not limited to, your racial or ethnic origin, philosophical or religious beliefs or affiliations, sexual preferences or practices, membership of political, professional, or trade associations (to book at special rates), biometric and genetic information, passwords and financial and health information. Please note that, where necessary to make travel arrangements, we may collect personal information about children of any age from a responsible adult. Still, we do not knowingly collect such information directly from children.

We will only collect sensitive information in a manner that complies with your local data protection legislation, with your express consent, and where it is reasonably necessary to do so for one or more of our activities or functions (e.g., arranging travel arrangements), unless we are otherwise required or permitted to do so by law. To the extent permitted or required under your local data protection laws, you consent to our use and disclosure of your sensitive information for the purposes for which it was collected. For example, if you provide us with your health information in connection with an application for travel insurance for a prospective trip, you consent to our use and disclosure of that information in connection with the administration of such travel insurance on your behalf. Another example of such use or disclosure is your disclosure of your religious beliefs because you are interested in, for example, specific vacation packages, in which case you consent to our use and disclosure of such information to facilitate your request. We will not use or disclose sensitive information for purposes other than those for which it was collected unless we subsequently receive your consent to use it for other purposes.

We will only collect personal information in a manner that complies with your local data protection legislation. We usually collect your personal information directly from you as part of your relationship with us. We will collect this information directly from you unless it is unreasonable or impossible to do so.

In general, such collection will occur:

  • When you communicate with us in person, by telephone, by mail. or by e-mail,
  • When you visit one of our Web sites; or
  •  When you contact us through social networks.

We may collect personal information about you:

  • When you purchase or make inquiries about travel arrangements or other products and services,
  •  When you enter contests or register for promotions,
  • When you subscribe to receive marketing materials from us (e.g., electronic newsletters),
  • When you request brochures or other information from us or
  • When you provide information or use our services on social networks.

We may also collect your personal information (other than sensitive information) when you complete surveys or provide us with feedback unless you choose to do so pseudonymously or anonymously.

In certain circumstances, we may need to collect personal information about you from a third party. This includes when someone makes a travel booking on your behalf, including travel arrangements that you will use (e.g., a family or group booking or a travel booking made for you by your employer). When this happens, we will rely on the authority of the person making the said travel booking to act on behalf of any other travelers included in the booking.

When you make a travel reservation on behalf of another person (e.g., a family or group reservation or a travel reservation made for an employee), you represent that you have obtained that other person’s consent to Deztination’s collection, use, and disclosure of that person’s personal information in accordance with this Statement, and you further represent that you have informed that person of this Statement.

You must inform us immediately if you become aware that your personal information has been provided to us by another person without your consent or if you have not obtained consent before providing us with another person’s personal information.

We make every effort to maintain the accuracy and completeness of the personal information we store and to ensure that all your personal information is up to date. However, you can greatly assist us in this regard by contacting us promptly if your personal information changes or if you become aware that we have inaccurate personal information about you (see section 14 below). We will not be liable for any loss resulting from inaccurate, false, imperfect, or incomplete personal information provided by you or anyone acting on your behalf.

  1. How we use your information

We use your personal information for the following purposes:

  • To provide, offer, and personalize our products and services required or likely to be of interest to you,
  • To process information relating to your purchases and service requests and to process payment for them,
  • Send marketing communications if you have given your consent,
  • Manage and maintain your records and accounts created for our various products, services, and programs,
  • Improve and optimize our website and services,
  • Manage risk, security, regulatory compliance, organizational governance, and the membership meeting process,
  • Provide quotations for requests for proposals,
  • Communicate with you, responding to questions, requests for advice, comments, or complaints,
  • Respond to your requests and provide you with customer service,
  • Verify the identity of members and customers, when required, for transactional purposes as well as to reduce fraud or errors in transaction processing,
  • Determine your eligibility for our products and services and verify compliance with any conditions that may apply,
  • Invite you to events, organize promotional activities and contests,
  • Conduct studies, surveys, and analyses, carry out targeting and segmentation, and compile statistics to establish pricing, understand and analyze the interests, needs, and preferences of members and customers,
  • Ensure the quality of products and services, conduct internal audits, or carry out continuous improvement activities,
  • Ensure the safety and protection of people and property in our facilities,
  • Prevent, detect, and protect against fraud and attempted fraud,
  • Conducting investigations and enforcing the law,
  • Complying with applicable laws and regulatory requirements,
  • Communicate with you about any changes to our programs, their operation, and our policies, including this policy.

Specifically, when you contact us regarding a travel question or reservation, the purpose for which we collect your personal information is generally to provide you with travel advice and/or to assist you in making a reservation for travel and/or travel-related products and services. However, the purpose of collection may vary depending on the circumstances, as specified in this Statement (e.g., collection of your personal information to enter a contest, providing feedback, etc.).

When you make a reservation or otherwise arrange any of the travel products and services through us, we usually act as an agent for the relevant travel service providers (e.g., for a hotel). In such cases, we process your personal information as necessary to provide the services you have requested. This generally includes the collection of your personal information both for internal purposes as described in this Statement and for the travel service provider for whom we are acting as an agent (e.g., to provide you with the services you have booked). For example, if you book a flight through us, we use your personal information to ensure that your seat on the flight is reserved and to inform the airline of this reservation so that the airline can provide you with the flight service.

We may share your information with our travel service providers, such as hotels, airlines, car rental companies, and other suppliers who fulfill your travel reservations. Please note that these travel service providers may also use your personal information per the provisions of their respective privacy policies and may contact you as necessary to obtain additional information about you, facilitate your travel booking, or provide you with the services you requested. We encourage you to review the privacy policies of all third-party travel suppliers from whom you purchase products through us. We will provide copies of all travel service providers’ terms, conditions, and privacy policies upon request.

We act as an agent for, or on behalf of, thousands of travel service providers worldwide, so it is impossible for us to list all the travel service providers we act for or their locations in this Statement. To learn more about disclosing personal information to travel service providers outside Canada, please see section 6 below.

If you have any concerns about transferring your personal information to a travel service provider or would like to contact us for more information, please see “Comments, Complaints, Contact Us” below (section 14).

We also collect personal information for the following purposes:

  • To provide you with the services and tools you wish to use (e.g., to save your travel preferences on our websites in a wish list or to save personal information to enable pre-filling of online forms),
  • To detect errors,
  • To protect against, prevent, detect, and investigate fraudulent, unauthorized, or illegal activities,
  • For regulatory reporting and compliance purposes,
  • To develop and improve our products and services and those of our related entities.
  • To manage our relationship with you by, among other things, creating and maintaining a customer profile to enable our brands to serve you better or by presenting options on our website that we believe may be of interest to you based on your browsing history and preferences,
  • To involve you in market research, assess customer satisfaction and solicit your feedback regarding our relationship with you and/or the service we have provided to you,
  • To facilitate your participation in loyalty programs,
  • To conduct research and analysis related to our business and services, including trends and preferences in sales and travel destinations and the use of our websites,
  • For internal accounting and administrative purposes
  • To comply with our legal obligations, including responding to requests from law enforcement or government authorities, as well as applicable customs/immigration requirements in connection with your travel and
  • For the purpose authorized or required by law (e.g., to prevent a threat to life, health, or safety, or to enforce our legal rights).

Where permitted by local data protection legislation, we may use your personal information to send you targeted marketing activities relating to our products and services (and those of third parties) which we believe may be of interest to you, unless you have requested not to receive such information. This may include, but is not limited to, direct mail, electronic marketing, and notifications, as described below, and telephone calls). We will use your personal information to send you electronic marketing materials (including electronic newsletters, e-mails, text messages, and chats) only if you have opted to receive them or if you have not opted in, as required by applicable law. You can sign up to receive e-newsletters and other electronic marketing and promotional materials by following the appropriate links on our website or by having one of our consultants do it for you.

If you no longer wish to receive promotional or marketing materials from us, participate in market research, or receive other types of communication from us, please see “Comments, Complaints, Contact Us” below (section 14). You may unsubscribe from mailings of electronic marketing materials by following the unsubscribe prompt in your e-mail, text message chat, or any other form of electronic marketing. Please also see the “Your Rights” section of this Statement for information on how to unsubscribe at any time or limit the use of your browsing history for online behavioral advertising purposes.

  1. Sharing your information

We do not sell, rent, or trade your personal information now or in the future. We will disclose your personal information to third parties only as described in this Statement and as set out below and in accordance with your local data protection legislation. Please note that, in this Statement, the word “disclosure” includes transferring, communicating (whether verbally or in writing), sending or making available or accessible your personal information to another person or entity.

Your personal information may be disclosed to the following third parties:

  • With your consent,
  • With third-party service providers and suppliers who help us operate our website and provide our services,
    • IT solution providers who help us provide products and services to you (such as any external data hosting providers we may use),
    • Publishers, printing facilities, and distributors of marketing materials,
    • Event and exhibition organizers,
    • Marketing, marketing research, research and analysis, and communications agencies,
    • Direct mail companies, freight services, courier services and,
    • External business advisors (lawyers, accountants, auditors, and recruitment consultants,
  • Our related entities and brands
  • Travel service providers such as travel wholesalers, tour operators, air carriers, hotel establishments, car rental companies, transfer handlers and other related service providers,
  • To comply with our legal obligations,
  • Financial institutions, such as banks, that process financial transactions,
  • A person who makes your travel reservation on your behalf, if you are traveling using a reservation made on your behalf by another person (e.g., a family member, friend, or work colleague), 
  • Your employer, when you are an employee of one of our corporate, commercial, or government customers and are attending an event or traveling for business purposes,
  • A person who can confirm to us that they have a relationship with you (e.g., a family member) when you are unreachable, the person correctly answers our required security questions, and the request is, in our opinion, in your best interest (e.g., when a person is concerned about your well-being or needs to act on your behalf due to unforeseen circumstances,
  • Various regulatory bodies and law enforcement agencies and officials, including fraud protection and related security purposes,
  • Law enforcement agencies when we suspect that illegal activities have actually or possibly occurred and the personal information is a necessary part of our investigation or reporting of the matter, and, 
  • Third-party services or applications when you them to log into your account (e.g. if you use a third-party service or application (e.g., Facebook or Google) to log in. your Deztination account, we disclose certain personal information to the third party in question,
  • In the event of a merger, acquisition, or sale of all or part of our business, your information may be transferred to another entity.

When you use us to book flights on your behalf, we will provide your personal information (i.e., your name, e-mail address, and/or cell phone number) to the airline in question. This lets airlines directly inform passengers of irregular flight operations or interruptions (e.g., flight cancellations and schedule changes).

With the exception of the above, we will not disclose your personal information without your consent unless we reasonably believe that disclosure is necessary to mitigate or prevent a threat to the life, health, or security of an individual or to public health or safety, or for certain actions to be taken by a law enforcement agency (e.g., prevention, detection, investigation, prosecution). (e.g., prevention, detection, investigation, prosecution, or punishment of criminal offenses) or where such disclosure is authorized or required by law (including applicable privacy/data protection laws).

On our websites, you may choose to use certain features to which we may have access or for which we partner with other entities not affiliated with us. These features, which include social networks and geolocation tools, are operated by third parties, including social networks, and are clearly identified as such. These third parties may use or share personal information in accordance with their own privacy policies. We strongly suggest that you consult the third parties’ privacy policies if you use the features in question.

  1. Transfers personal information abroad

We may disclose your personal information to recipients abroad, as specified below. We will ensure that any such international transfers are necessary for the performance of a contract between you and the foreign recipient and be subject to appropriate or suitable safeguards as required by your local data protection legislation (e.g., RGPD, China Cybersecurity Law, etc.).

Information may be transferred to a foreign recipient (other than any of our overseas related entities) located in a jurisdiction where you cannot seek redress under your local data protection legislation and which does not have an equivalent level of data protection as in your jurisdiction. To the extent permitted by your local data protection legislation, we will not be responsible for how such foreign recipients manage, store, and process your personal information.

  • Our foreign affiliates

Deztination operates a Canadian company with connections to entities around the world, including and not limited to Australia, New Zealand, Canada, the United States, the United Kingdom, South Africa, Morocco, Hong Kong, India, China, Singapore, Japan, the United Arab Emirates, Ireland, the Netherlands, Malaysia, Mexico, the Dominican Republic, Costa Rica, the Philippines, Germany, Norway, Sweden, Denmark, Finland, Spain, France, and Switzerland. Your personal information may be communicated to our related entities abroad to facilitate your travel booking and/or enable the performance of administrative, advisory, and technical services, including storing and processing such information. This includes “single sign-on,” which allows you to log into a shared account across all our brands using a single set of login details to view, for example, bookings you have made across our group companies’ various websites, apps, and services on your account page, and allows our group companies to display the account information you have with each of them.

  • Overseas Travel Service Providers

In providing services on your behalf, we may need to disclose personal information to relevant overseas travel service providers. We deal with many travel service providers worldwide, so the location of a travel service provider relevant to your personal information will depend on the travel services provided. In most cases, the relevant travel service providers will receive your personal information in the country where they provide your services or where their business or management is located.

  • Our third-party service providers located abroad

We may also disclose your personal information to third parties located abroad for the purposes of their performing services for us, including storing and processing such information. Generally, we will disclose your personal information to such overseas recipients only to facilitate your travel booking and/or enable the performance of administrative and technical services by them on our behalf.

  • Legal Obligations Regarding Cybersecurity in China

Personal information that is collected and generated on the territory of the People’s Republic of China is stored on the territory of China, except in the following situations:

  1. When the international transfer of information is required or authorized by the traveler
  2. We may transfer your personal information abroad when you use our platform to make reservations with hotels and airlines and to book travel-related services or products abroad.

We will ensure that such international transfers are necessary for the performance of a contract between you and the foreign recipient or are accompanied by appropriate safeguards or adapted in accordance with the local legislation that applies to you.

We use key service providers located in India, Indonesia, the Philippines, Hong Kong, the United States, the United Kingdom, Spain, and Australia. We also deal with many different service providers around the world, so we can’t list in this Statement all the countries to which we may send your personal information. However, if you have specific questions about which territories or persons will receive your personal information, please see “Comments, Complaints, Contact Us” below (section 14).

  1. Your rights

You have certain rights regarding your personal information, including the right to access, correct, delete, restrict processing, and object to the processing of your information. To exercise these rights, please contact us at dez@deztination.travel.

If you wish to make a Subject Access Request to:

  • View, update, amend, rectify, delete, object to, or obtain a copy of the personal information we hold about you, or
  • Limit or prevent our use of the personal information we hold about you, including by withdrawing any consent you have previously given to the processing of such information or
  • In cases where personal information has been processed on the basis of your consent or, if necessary, to perform a contract to which you are a party, request a copy of such personal information in an appropriate machine-readable format or request that we transfer such personal information to another controller.

You may make such a request by contacting us as described in Section 14 below. You will receive an acknowledgment of your request.

We endeavor to respond to such requests within a maximum of one month but reserve the right to exceed this period in the case of a complex request or if applicable law otherwise permits us to do so.

We also reserve the right to deny you access for any reason permitted under applicable law. Such reasons may include national security, corporate finance, and confidential references. If we refuse access to or correction of personal information, we will provide you with written reasons for such refusal unless it is unreasonable to do so, and where required by local data protection legislation, we will note your request and refusal in our records.

You have the right to file a complaint with a competent supervisory authority.

Any further correspondence in relation to your request should be in writing and addressed to the relevant Data Protection Officer as set out in section 14 below.

Please note that if you request that we limit or cease our use of the personal information we hold about you, or if you withdraw consent, you have already given to the processing of such information, this may affect our ability to provide services to you or harm the services we can provide to you. For example, most travel reservations must be made under the traveler’s full name and include contact information and appropriate identification (e.g., passport details). We cannot make reservations for you without this information.

You must always provide accurate information and agree to update it whenever necessary. You also agree that, in the absence of such updating, we may assume that the information submitted to us is accurate unless we subsequently learn that it is not.

You can tell us not to send you marketing communications by e-mail at any time by clicking on the unsubscribe link in any marketing e-mail you receive from us or by contacting us as specified below (section 14).

In any of the situations described above, we may ask you to prove your identity by providing us with a copy of a valid form of identification to comply with our security obligations and to prevent unauthorized disclosure of personal information.

To the extent permitted by law, we reserve the right to charge you a reasonable administrative fee for any manifestly unfounded or excessive request for access to your personal information and for any additional copies of personal information you request.

  1. Data security

We take reasonable security measures to protect your personal information from loss, unauthorized access, disclosure, alteration, or destruction.

To this end, we will implement and maintain technical and organizational measures necessary to ensure an appropriate level of security to protect personal information provided to us against accidental or unlawful destruction, loss, modification, unauthorized disclosure, or access to personal information transmitted, stored, or otherwise processed. Deztination has implemented various physical, electronic, and organizational security procedures to protect personal information held by the company against loss and misuse, as well as unauthorized access, modification, disclosure, and interference. Deztination regularly reviews security technologies and will strive to protect your personal information, as well as protect our own confidential information. Deztination is not responsible for the actions of any third party or its security controls with respect to information that third parties may collect or process through their websites, services, or otherwise.

We will destroy or anonymize personal information once we no longer need it for business purposes or as required by law.

  1. Integration of social networks

Our websites and mobile applications may use social network features and widgets (e.g., “Like” and “Share” buttons and widgets) (” Social Network Features “). These are provided and operated by third-party companies (e.g., Facebook) and are either hosted by a third party or hosted directly on our website or mobile application. The Social Network Features may collect information such as the page you visit on our website/mobile app and your IP address, and the Features may set cookies to enable them to function properly.

If you are logged in to your account with such a third-party company, the latter may then possibly link the information collected about your visit to and use of our website or mobile application with that of your account with the social network in question. Similarly, this third party may record your interactions with social network features. In addition, the third-party company may send us information in accordance with their policies, such as your name, profile picture, gender, friends list, and any other information you have chosen to make available. We may share information with the third-party company for the purpose of delivering targeted marketing to you through the third-party social network platform. You can manage information sharing and opt out of receiving targeted marketing communications by configuring your account privacy settings on the third-party social network platform.

Your interactions with these social network features are subject to the privacy policy of the third-party company that provides these features. For more information about the data practices of these third-party companies and to learn more about what personal information is collected about you and how the third party uses that personal information, please consult their privacy policy directly.

  1. IP addresses

When you access our website, use one of our mobile applications or open correspondence or electronic communications from us, our servers may record data about your device and the network you use to connect to us, including your IP address. An IP address is a series of numbers that identify your computer and are generally assigned when you access the Internet.

We may use IP addresses for system administration, investigate security issues, and compile anonymous data about our website and/or mobile applications. We may also link IP addresses to other personal information we hold about you and use it for the purposes described above (e.g., to better tailor our marketing and advertising materials, provided you have opted to receive electronic marketing materials).
