GENERAL AND ONLINE SALES CONDITIONS
Please ensure that you carefully read and understand both the general terms and conditions and the online sales conditions before making an online reservation.
These Terms and Conditions are legally binding between the traveller(s) and Deztnation Inc, herein after referred to as Deztination.
VALIDITY OF PRICES AND AVAILABILITY
The prices advertised on our online sales site remain valid as long as the user remains connected to the session in question. Should the user become disconnected or should the session close, prices may be different when re-connecting. Before making a reservation, the availability and price of the services you wish to purchase are subject to change without notice.
Prices are based on the local currency rate at the time of quotation, converted according to the current exchange rate as determined by our suppliers. Prices are subject to change without notice until a reservation is confirmed. The prices include planning, fees, and operational charges.
Unless otherwise stated, prices do not include any local taxes or fees, such as foreign departure fees, security, port fees, parking fees, customs, immigration, agricultural fees, airport taxes or international transportation taxes. Prices do not include gratuities that may be given to tour leaders, drivers or local guides, passport and visa fees, personal and luggage insurance, any items of a personal nature, taxes or duties, and any food or drink not explicitly listed under “Price Includes” on the product pages of the Website.
PURCHASE AND METHODS OF PAYMENT
Only Visa, Mastercard and American Express credit cards are accepted for online payments. Payment may be divided into several transactions on your credit card statement depending on the methods of payment of different suppliers.
** The name on the credit or debit card must be the same as one of the traveller.**
At the time of payment, the reservation platform will collect payment in full. Deztination.travel cannot be held responsible for the failure of a customer to make the final payment.
Full payment is required at the time of any and all reservations made on the platform. By providing his credit card number electronically, the customer agrees to respect the present online sales conditions as well as the general terms and conditions, and authorizes the transaction for the security deposit and/or the transaction for the full purchase of services.
TRAVEL RESERVATION
At the time of reservation, it is imperative that the customer enter the names of the passengers as they appear on their respective passports. Should any of the names be written differently, the customer must inform us as soon as possible. Modification fees shall apply in such cases.
To make a reservation, you must provide the following information:
- Last name, first name, as indicated on your passport
- Date of birth of the participants
- Street address
- Phone number
Customers understand and agree that they are reserving a trip on their own, without the help of a travel consultant. Customers who have any questions or experience difficulty understanding the services offered on the reservation platform are responsible for contacting us via the platform.
As a condition for making a reservation, you guarantee that:
- you are at least 18 years old;
- you have the authority to sign a contractual agreement with us and the relevant hotel reservation provider(s);
- you will only make reservations for yourself or for other persons for whom you are entitled to make such reservations (Other Persons);
- You will notify such other persons of these terms and conditions (as updated by us from time to time) and any other terms and conditions applicable to a Reservation;
- all information provided by you (including information provided on behalf of Other Persons) regarding a Reservation is accurate, complete and current; and
- you will comply with our acceptable use policy described below.
- You will not use our information for commercial purposes;
- You will not make reservations that are speculative, false or fraudulent or any reservation in anticipation of high demand;
Reminder: Flight schedules if purchased by Deztination for you are provided for information purposes only and are subject to change without notice. A minimum of one adult (18 years or older) must be present per room reserved for any trip.
TOURS ONLY(SELF-GUIDED OR ACCOMPANIED)
ACCOMMODATIONS: All accommodation, room type(s), and specifications are as shown in the itinerary. The style of accommodation indicated in the day-to-day itinerary is a guideline only and may change. On some occasions, alternative arrangements may need to be made due to the lack of availability of rooms in our preferred accommodation. In these cases, we will use a similar standard of accommodation.
Throughout the trip, we request that our properties prepare rooms in time for our arrival, especially if we’re arriving before normal check-in time. However, this isn’t always possible which means we won’t be able to check-in immediately on arrival at some hotels. Instead, we can store our luggage and explore our new destination or on some trips, have use of shared day rooms until all rooms are available
MEALS: Included meals are as shown in the itinerary. To give you the maximum flexibility in deciding where, what, and with whom to eat, generally, not all meals are included in the trip price. This also gives you more budgeting flexibility. As a rule, our groups tend to eat together to enable you to taste a larger variety of dishes and enjoy each other’s company. There’s no obligation to do this, though. If you have dietary requirements and/or food allergies, please let your booking agent know before departure. Your group leader can suggest restaurants to try during your trip.
TRANSFERS: Transfers upon arrival and departure from the airport to the hotel and return may or may not be included; please check your itinerary for details.
TRANSPORTATION: Transportation will be as specified in the itinerary.
BAGGAGE: Deztination may or may not provide handling of baggage and only as specified in the quotation. Weight restrictions for baggage on some routes on internal/domestic flights or train may apply, details of which will be provided with pre-tour documentation. Baggage and personal effects are at the owner’s risk throughout the tour, and Deztination assumes no liability for lost or damaged baggage. Baggage insurance is strongly advised. Please check with your international carrier for other baggage restrictions applicable to your international flight which are not provided by Deztination.
ITINERARY: Accommodation and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond Deztination’s control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued. Deztination also reserves the right to withdraw a tour or any part of it, to make such alterations to the itinerary or the tour inclusions as it deems necessary or desirable, and to pass on to tour members any expenditures or losses caused by delays or events beyond its control. In case of any appreciable variation in the tour price due to these circumstances, Deztination reserves the right to adjust the tour costs as necessary.
TAXES AND GRATUITIES: Hotel taxes as imposed by city and state governments are included. Airport taxes are included where specified in the itinerary. Gratuities for guides, drivers, porters, camp staff, ship crew, and Tour Managers are not included and are at the traveller’s discretion.
PHOTOGRAPHY: Deztination reserves the right to take photographs during the operation of any of its tour program or part thereof and to use them for promotional purposes. By booking a tour with Deztination, travellers agree to allow their images to be used in such photographs. Travellers who prefer that their images not be used are asked to identify themselves to Deztination prior to final payment, and they will be exempted from this photography waiver clause.
SPECIAL REQUESTS
Specific requests should be advised at the time of booking. Please note that every effort will be made to secure special requests, however, they cannot be guaranteed.
TRAVEL DOCUMENTS, PASSPORTS AND VISAS
Once the customer has completed his online reservation, Deztination will send an email confirming the reservation details to the address provided by the customer. It is the customer’s responsibility to verify that what he/she has booked is accurate and in accordance with the desired trip. It is the customer’s responsibility to validate that the services indicated correspond faithfully to the products and services chosen and that the names of the participants are identical to their identification documents. For any issues, please see the MODIFICATIONS section below.
As previously mentioned, it is imperative that customers enter the names of the individuals for whom they are reserving a trip as they appear in their respective passports.
Please note that passport holders are responsible for obtaining the required documentation applicable for entry. Please note also that passports must be valid for at least six (6) months after completion of your journey and should also have sufficient blank pages for visas and immigration stamps. Deztination cannot be held responsible should you be denied entry to a country due to non-compliance with these requirements. Should you require specific information ahead of travel, please consult the travel advice produced by the government of your home jurisdiction, as well as that of the government who issued the passport and/or visa you intend to travel under.
PHOTOGRAPHY
The use of drones for photography, or any other purpose, is forbidden on any Deztination trip unless permission has been previously sought from, and granted by, Deztination and the proper local authorities. Please remember, we are guests in the countries through which we travel and we may sometimes inadvertently cause offence by taking photographs without first asking permission.
Also, many countries have very strict rules about taking photos of army, police, or any official personnel; restrictions apply at borders, bridges, and any government building. Please exercise care in this regard, as the penalty may be to have your film and/or camera confiscated.
DESCRIPTIONS AND IMAGERY
All photographs, imagery, and descriptions used by Deztination online and within promotional documentation have been included with the intention of presenting a true and accurate reflection of your holiday destination. However, due to circumstances beyond our control, it is foreseeable that some destinations will change in appearance throughout the year, and so may appear to have varied at the time of your stay. e.g., due to weather, the number of tourists, or many other factors. Deztination will of course, make every attempt to notify you in advance of your trip as to whether such instances have had any effect on the accommodation or its surroundings if we are made aware of the same, however cannot be held liable in this regard.
MODIFICATIONS
For all modifications or additions to the package booked online, a fee of 50$ per person will be charged for the processing of the file, in addition to the inherent fees of the suppliers to the modification or addition. The client must communicate by email indicated on his confirmation email. A change of date will be considered as a cancellation and subject to the conditions of cancellation of Deztination and its suppliers. Theater, show, and special event tickets cannot be changed. The sale of these tickets is binding and final and cannot be changed after the original purchase has been confirmed.
ACTIVITIES
Some activities may be pre-booked by you or Deztination however, should you wish to participate in other or additional activities we strongly advise that you book in advance so as to avoid disappointment. Some activities, such as and not limited to those which are boating and water related, are subject to weather and water levels. Deztination cannot be held responsible should such activities be amended and/or canceled as a result of such matters, over which Deztination has no control.
TRAVEL INSURANCE
Deztination strongly recommends all clients take out comprehensive travel insurance prior to the date of travel. This insurance should cover cancellation and curtailment, all medical expenses, including evacuation/repatriation, personal baggage, personal liability, death and permanent disability and travel document insurance. Please contact us for quotations.
Some credit cards include coverage when you use it to pay for your package. Check with your card issuer to find out what coverage they offer.
TRAVELING WITH CHILDREN
We recommend that if you are traveling with a child who does not share your surname, to minimize the possibility of disruption to your travel plans, you travel with documentation that proves your relationship to the child as well as documentation that proves you have permission to travel with them. Deztination cannot be held responsible should you or any member of your traveling party be denied entry to a country due to non-compliance with these requirements. Should you require further specific information ahead of travel, please consult the travel advice produced by the government of your home jurisdiction, as well as that of the government who issued the passport and/or visa you intend to travel under.
Due to the nature of some of the excursions and activities involved in Deztination trips, minimum age requirements are in place at some destinations. Additionally, some accommodations require that children below a certain age share a room with an adult. Such circumstances vary and will be specified within your itinerary, ahead of travel, and at the time of booking.
CANCELLATIONS
The cancellation conditions for trips booked with Deztination may, in some cases, reflect the cancellation conditions of our suppliers and partners and can be fully non-refundable. It is possible to ask us for the cancellation conditions for each service of your reservation if applicable. In case of cancellation after having paid the final payment, the cancellation fee will represent what the suppliers and partners charge to Deztination according to the contracts negotiated between them and the following fees:
- 6 months or more before the departure date: 10% +$50 administration fee per person and the cancellation fee of the supplier(s)
- From 3 to 6 months hours before departure date: 50% of the total amount of the invoice is non-refundable as well as the cancellation fees of the supplier(s).
- Less than 3 months before departure date: 100% of the total amount of the invoice is non-refundable.
- Theater, shows, special events, and train tickets cannot be modified or canceled. The sale of these tickets is binding and final and cannot be changed after the original purchase has been confirmed.
- Cancellation of airline tickets will be subject to the refund policy of each individual airline and may be greater than the percentages above particularly when low cost/net based fares are used.
***It can happen that the cancellation conditions of a supplier are more severe than those of Deztination. In this case, the supplier’s conditions will prevail and these fees will be added to those indicated above. Contact us to know the cancellation conditions for each service if necessary or consult your transaction confirmation.***
If you wish to cancel your purchase, you must contact us immediately by email or via the contact us feature on the website. Under no circumstances will sending an email or web message without receiving a response from customer care or travel specialist cancel your online purchase.
A cancellation request must be made in writing and the date of receipt of the notice will be used as the date of cancellation in calculating the fee charged by the supplier(s). These cancellation fees vary by supplier and/or type of service and are calculated based on the number of days the cancellation is recorded in relation to the travel date.
Any change made to the reservation (including, but not limited to, the names and number of travellers, dates, destination or duration of the trip) may be considered a cancellation and subject to the supplier’s cancellation fees.
Deztination reserves the right to charge additional cancellation or change fees, in addition to any other fees charged by the service provider.
UNUSED SERVICES
No refund will be given for any service not used, voluntarily or otherwise, during your stay, nor can it be rescheduled to a later date. If you were unable to use your service due to the fault of a provider, it is recommended that you make arrangements with the provider on site for a refund or rescheduling of service.
Regardless of the circumstances of an early return (illness, personal decision, etc.), the unfinished portion of the trip is not refundable. The traveller is not entitled to any refund or compensation if the cancellation of the trip is imposed by circumstances of force majeure or climatic or natural events (cyclone, storm, hurricane, volcanic eruption, earthquake, landslide, pandemic or any other disaster or accident impossible to predict or avoid). In this case, Deztination can cancel the trip without notice.
LIMITS ON DEZTINATION’S RESPONSIBILITY
Deztination its employees, shareholders, officers, directors, successors, agents and assigns (collectively Deztination), does not own or operate any entity which is to or does provide goods or services for your trip with the exception of a limited number of vehicles. It purchases transportation (by aircraft, coach, train, vessel, or otherwise), hotel and other lodging accommodations, restaurant, ground handling, and other services from various independent suppliers (including, from time to time, other affiliated Deztination companies). All such persons and entities are independent contractors. As a result, Deztination is not liable for any negligent or willful act of any such person or entity or of any third person.
In addition and without limitation, Deztination is not responsible for any injury, financial or physical loss, death, inconvenience, delay, or damage to personal property in connection to the provision of any goods or services, whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failures of aircraft or other means of transportation or for the failure of any transport mechanism to arrive or depart on time.
There are many inherent risks in travel of the type involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities.
If you decide to participate in any activities including, but not limited to, any excursions involving animals, riding on animals, Scuba diving, snorkeling, boating, hot air ballooning, zip-lining, high altitude treks, climbing, quad biking, parasailing, parachuting, kayaking, white-water rafting, primate tracking and any activity which Deztination considers to carry inherent risks of serious illness, injury or death (“Activities”) then you fully understand and acknowledge that Activities carry with them various inherent risks, including serious illness, injury or death and you take complete responsibility for your own health and safety and agree to assume all risks of injury, illness or death, whether foreseen or unforeseen that may befall you as a result of participating in any Activities and agree to release Deztination and its affiliates, their agents, employees and representatives from any liability whatsoever related thereto, to the fullest extent permitted by law.
Further, as consideration for being permitted to participate in the Activities, you release Deztination, whether known or unknown, from, and agree not to sue or make claim against Deztination for property damage, cancellation of any activities for any reason, illness, negligent rescue operations or procedures, personal injury or death arising from your participation in the Activities, and any activity related thereto, including transportation to and from the site of the Activities, regardless of whether such property damage, illness, personal injury, or death results from the negligence of Deztination (but not its reckless, willful, or fraudulent conduct) and/or from any defect in equipment. You further agree to indemnify and hold Deztination harmless with respect to any claim made against Deztination by anyone else which a) related to your participation, or b) would be subject to the above release and covenant not to sue if you had made this claim directly yourself.
TRAVELLERS’ REPRESENTATIONS
If you or any member of your party has any medical problem or disability which may affect your stay, please provide us with full details before purchasing and confirming your booking so that we can try to advise you as to the suitability of your chosen arrangements. We may require you to produce a doctor’s certificate certifying that you are fit to participate in the tour.
Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.
ITINERARY CHANGES
Our itineraries are updated regularly throughout the year based on customer feedback and to reflect the current situation in each destination. Due to weather, local conditions, transport schedules, public holidays, or other factors, further changes may be necessary to your itinerary once in-country. The order and timing of included activities in each location may also vary seasonally to ensure our travellers have the best experience.
CANCELLATION BY DEZTINATION
We reserve the right in any circumstances to cancel your holiday for any reason. However, we will not cancel your hotel arrangement less than 10 days before your departure date if purchased 10 days prior to departure, except for reasons of force majeure or failure by you to pay the final balance. If you fail to pay any balance of the holiday price prior to departure, Deztination will treat your booking as canceled and levy the cancellation charges set out in the FORCE MAJEURE clause. If Deztination is obliged to cancel your holiday in any other circumstances before departure, Deztination will use its best endeavors to offer alternative arrangements of equivalent or very closely similar standards and price, if available; travel arrangements of a lower standard and a refund of the price difference; or will give you a full and prompt refund of all monies paid.
FORCE MAJEURE
Force majeure means unusual and unforeseeable circumstances beyond Deztination’s control or the control of our suppliers, the consequence of which neither Deztination nor its suppliers could avoid even with all due care, including, but not limited to, non payment, war, threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, unavoidable technical problems with the website, transport, machinery or equipment, power failure, changes imposed by rescheduling or cancellation of flights by an airline, natural or nuclear disaster, fire, flood, drought, adverse weather conditions, epidemics or outbreaks of illness and level of water in rivers.
In the event of a cancellation or material alteration to the trip as a result of the circumstances as described in this clause, Deztination may in their sole and absolute discretion:
- offer the traveller (s) alternative travel arrangements or products of comparable standard as may be appropriate in the circumstances
- if alternative travel arrangements or products are not offered by Deztination, Deztination will make a prompt proportional refund of monies paid by the traveller.
Deztination may charge a reasonable fee to cover the administration costs associated with providing alternative travel arrangements or products. In the event of non-payment, the transaction will be null and void and administrative cost may be imposed.
HEALTH PRECAUTIONS
Some top tips for staying healthy:
- Ensure you have the correct vaccinations before you travel and that you take an adequate supply of any prescription medication with you.
Remember – high-factor sun cream is recommended. - Make sure you drink plenty of (clean) water – dehydration is very common when traveling – but avoid ice cubes as they may be made from un-purified water.
- Wash your hands regularly. You can buy antibacterial dry hand gel.
- Use insect repellent and long sleeves to avoid getting bitten, even in non-malarial areas.
- If flying long-haul to your destination please be aware of what you can do to minimize the risks of DVT (Deep Vein Thrombosis). Some useful information can be found here https://www.goflighthealth.com/
- If required, please ensure that you consult your personal physician about anti-malaria precautions, other inoculations and vaccinations and/or high-altitude sickness before travel. Where applicable, please ensure that while traveling, you carry a valid Yellow Fever certificate.
Deztination is not responsible for travellers’ health and well-being, and that travellers should consult their doctors regarding necessary vaccinations and health precautions.
TRAVEL ADVISORIES/WARNINGS
It is the responsibility of travellers to become informed about the most current travel advisories and warnings by referring to their respective government agencies. In the event of an active State Department or Government Agency Travel Warning against travel to specific destination location(s) of the trip, should the traveller still choose to travel, notwithstanding any travel advisory or warning, the traveller assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.
Most national governments provide regularly updated foreign travel advice on safety issues involved with international travel. We recommend that you check your government’s advice for their latest travel information before departure and ensure that your travel insurance covers you for all destinations and activities on your trip. Deztination is not liable for issues arising from travel to destinations with active warnings.
COMPLAINTS RESOLUTION AND ARBITRATION
If you have a complaint or a problematic situation to share with us, you must contact Deztination immediately so that we can try to remedy the situation when it occurs. If the situation occurs outside of our business hours, please send us the information in writing within 7 days of your return. After this period, we cannot guarantee any compensation, if any, from us or the supplier.
Any claim arising out of or relating to these Terms and Conditions, to the Limits on Deztination’s Responsibility clause, to the website, to the brochures, to any information relating in any way to the trip, to the trip itself or to any products or services related to the trip, shall be settled in the first instance by binding arbitration in the applicable legal forum as detailed in clause Applicable Laws and Forum of these Terms and Conditions. In lieu of a personal appearance at arbitration the arbitration may be conducted by telephonic means. Arbitration is the exclusive forum in the first instance for dispute resolution and except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.
APPLICABLE LAW AND FORUM
This agreement shall be construed, interpreted and enforced in accordance with, and shall be governed by the laws of Quebec. It is agreed between Deztination and the travellers that all lawsuits against Deztination arising under, in connection with, or incidental to the tour shall be filed, if at all, in the courts of Quebec to the exclusion of the courts of or in any other country or jurisdiction.
MODIFICATIONS OF THE PRESENT CONDITIONS
Deztination reserves the right to modify at any time the present conditions according to the modifications of the legislation or for any other legitimate reasons. Your use of this site will be governed by the conditions then in force at the time of your use.
NOTICE TO CUSTOMERS
Deztination acts as an intermediary between different suppliers and their customers. Therefore, when making an online transaction, customers accept full responsibility for the purchases they make on the reservation site, without the advice or recommendations of a travel consultant. Deztination. can in no way be held responsible for harm or prejudice caused to customers who make such transactions without the help of a travel consultant.
TRAVEL AGENCY LICENSE
The travel agency license issued to Deztination for the operations of Deztination by the Office de la protection du consommateur requires us to hold a trust account and to deposit any money received from customers. This money must be used only to organize the trip of the customer and to pay the suppliers on his behalf.
